Actively Employed definition

Actively Employed.� means the employee has been at work and performing assigned duties for at least 80 percent of the work days over the previous 12 months.
Actively Employedmeans the period during which the Participant performs work for the Company or its Subsidiaries. “Actively Employed� shall be deemed to include (A) any period of paid time off or other approved leave of absence, and (B) if applicable, any period constituting the minimum notice of termination period that is required to be provided to the Participants pursuant to the Ontario Employment Standards Act, 2000 as amended from time to time (“E�). For the avoidance of doubt, “Actively Employed� shall be deemed to exclude any other period that follows or ought to have followed the later of (x) the end of the applicable ESA notice period or (y) or the last day that the Participant performs work for the Company or its Subsidiaries (including any period of paid time off or approved leave of absence), whether that period arises from a contractual or common law right.
Actively Employedmeans only the period during which the Employee is employed by the Employer performing the Employee’s customary duties for the Employer and the minimum period of notice of termination prescribed by the ESA (if any), and without regard to whether the Employee continues to receive compensatory payments beyond the last day the Employee perform the Employee’s customary duties for the Employer or are paid salary in lieu of notice of termination. For greater certainty, “Actively Employed� excludes any contractual or common law entitlement to any period of notice or pay in lieu of notice in excess of the Employee’s minimum statutory entitlements under the ESA.

Examples of Actively Employed in a sentence

  • Employee must be Actively Employed (as defined below) on the date any Bonus is paid in order to be eligible to receive such Bonus, unless otherwise expressly required by the ESA in which case there shall be no further entitlements beyond the Employee’s minimum statutory entitlements.

  • If the Company determines, in its sole discretion, that you have engaged in misconduct that constitutes Cause, you agree that any unvested portion of the Award shall be immediately forfeited as of the date you are no longer Actively Employed with the Company.

  • If, for any reason, you cease to be Continuously and Actively Employed with the Company prior to the Resignation Date, no Retention Bonus will be paid under this Agreement.

  • If you are not Actively Employed for the entire 30 day period, Restricted Cover will continue until you have been Actively Employed for 30 consecutive days.If on or prior to the Recommencement Date, you have been diagnosed with a terminal illness or you have claimed or are eligible to receive a benefit in relation to terminal illness or total and permanent disablement cover from any source, your recommenced cover will be Restricted Cover.

  • If the Participant is not Actively Employed by the Company or a Related Corporation on the applicable Purchase Date for any reason, the Participant is deemed to have waived and forfeited any right to exercise the Purchase Right and to purchase Shares, and the Participant will not be eligible to exercise the Purchase Right or to purchase Shares or a pro-rated portion of Shares; s.
