Product Offerings.ĚýProducts available under this Contract are set forth herein and specified in Appendix E (Submission #’s 3, 4 and 5). These offerings may be updated during the Contract term to incorporate new Product offerings, price revisions and to delete items. Offering updates must be submitted under the Contract as soon as possible after Contractor announces them. This Contract is currently limited to sale, installation, and maintenance of Product (see also 3.3 Service Offerings). Leasing is not permitted at this time. The Commissioner reserves the right to amend the Contract at any time to incorporate lease offerings.

These offerings may be updated during the Contract term to incorporate new Product offerings, as well as price revisions and to discontinue items no longer offered by Microsoft. Product Offerings.Ěý2.1 Seller’s Remote Hands service offerings will vary depending on the facility requested and the time of day the service is requested. For those sites in which the service is available, Seller will offer different types of offerings, all based on response time and time of request. For purposes of the Remote Hands Product, “Response Timeâ€� shall be defined as the time starting when Seller’s NOC is called by Buyer, Buyer properly requests a Remote Hands service and a ticket is opened, and ending when Seller’s technician informs Seller’s NOC that he or she is on site at the requested site. Offerings by site and available sites may be amended from time to time by Seller and will be identified accordingly on the then current Service Order.

Product Offerings.ĚýAt all times throughout the Term (and any Sell-off Period), Licensee shall make available to the WHP E-Com Operator a collection of Licensed Products comprised of all styles and skus offered by Licensee to drop-ship customers, except for Licensed Products which Licensee may sell to a particular account on an exclusive basis (but no more than 10% of Licensee’s entire seasonal collection may fall within such exclusivity exception). Subject to any recommendations which Licensee may wish to provide to the WHP E-Com Operator (which the WHP E-Com Operator shall consider in its good-faith discretion), the WHP E-Com Operator at any time shall have the right to select any or all skus of Licensed Products from such offerings for sale on a Branded E-Com Site.
Product Offerings.ĚýFrom time to time, additional products may be added to the Product List upon mutual agreement of the parties. Notwithstanding the inclusion of any product on the Product List, 9 Squared reserves the right to not offer any product for sale for any or no reason. Without limiting the foregoing, all Supplier products must be approved by 9 Squared prior to being included for sale from a 9 Squared Product. In the event that Supplier decides to end of life any product currently on the Product List, Supplier shall notify 9 Squared as far in advance as possible of such end-of-life, but in no event less than ninety (90) days.
