Telecommunications CarriersÌýmeans Persons engaged in the business of providing telephone Internet, and data services to both business and consumer markets. “Termâ€� shall mean the term of this Agreement as provided in Section 21. â€�Third Partyâ€� shall mean, with respect to a party, any Person that is not an Affiliate of such party. “Updateâ€� shall mean any and all changes and updates to the licensed Technology that improve the general utility, efficiency, and operating performance of the licensed Technology without altering the basic function of the licensed Technology or adding new functionality. “Upgradeâ€� means any and all improvements in the licensed Technology that add to or alter the basic functions of the licensed Technology. Upgrades incorporate all Updates as well as all fixes for known errors.
