Access to Services.ĚýSubject to and in accordance with the terms of this Agreement, including any Schedules, Company grants You a non-exclusive, non-sublicensable, nontransferable, non-assignable, revocable license for the term of this Agreement to access and use the Services. Services may only be used by Your Users for internal business purposes only. You agree to comply with the terms and conditions of this Agreement, including any Schedules, and with all applicable Company procedures and policies that further define use of the Services. You acknowledge and agree that the actions of any of Your Users with respect to the Services will be deemed to be actions by You and that any breach by any of Your Users of the terms of this Agreement, including any Schedule, will be deemed to be a breach by You.
Access to Services.Ěý1. Subject to DHCS provider enrollment certification requirements, the Contractor shall maintain continuous availability and accessibility of covered services and facilities, service sites, and personnel to provide the covered services through use of DMC certified providers. Such services shall not be limited due to budgetary constraints.
2. When a beneficiary makes a request for covered services, the Contractor shall require services to be initiated with reasonable promptness. Contractor shall have a documented system for monitoring and evaluating the quality, appropriateness, and accessibility of care, including a system for addressing problems that develop regarding waiting times and appointments.
3. In addition to the coverage and authorization of service requirements set forth in Article II.E.4 of this Agreement, the Contractor shall:
i. Authorize DMC-ODS services in accordance with the medical necessity requirements specified in Title 22, Section 51303 and the coverage provisions of the approved State Medi-Cal Plan.
ii. Inform the beneficiary in accordance with Article II.G.2 of this Agreement if services are denied.
iii. Provide prior authorization for residential services within 24 hours of the prior authorization request being submitted by the provider.
a. Prior authorization is prohibited for non-residential DMC-ODS services.
b. The Contractor’s prior authorization process shall comply with the parity requirements set forth in 42 CFR §438.910(d).
iv. Review the DSM and ASAM Criteria documentation to ensure that the beneficiary meets the requirements for the service.
v. Have written policies and procedures for processing requests for initial and continuing authorization of services.
vi. Have a mechanism in place to ensure that there is consistent application of review criteria for authorization decisions and shall consult with the requesting provider when appropriate.
vii. Track the number, percentage of denied, and timeliness of requests for authorization for all DMC-ODS services that are submitted, processed, approved, and denied.
viii. Pursuant to 42 CFR 438.3(l), allow each beneficiary to choose his or her health professional to the extent possible and appropriate.
ix. Require that treatment programs are accessible to people with disabilities in accordance with CFR Title 45, Part 84 and the Americans with Disabilities Act.

Access to Services.ĚýThe Bank will provide instructions on how to use the Online Banking and Bill Payment & Presentment Services. You will gain access to your account online through the use of your Internet-enabled device, your ISP, your Username and your Password. You may access your accounts online 24 hours a day, seven (7) days a week. However, availability of the Services may be suspended for brief periods of time for purposes of maintenance, updating and revising the software. For purposes of transactions, the Bank's business days are Monday through Friday, excluding holidays and weekends. All Online Banking transaction requests received after 4:00 p.m. on business days and all transactions which are requested on Saturdays, Sundays, or holidays on which the Bank chooses to remain closed, will be processed on the Bank's next business day. The Bank's business day begins at 9:00 a.m.
Access to Services.ĚýThe IDT staff will arrange for, and instruct members on how to obtain, services. The IDT staff shall at a minimum:
a. Within thirty (30) calendar days of enrollment, document the member’s primary care provider, specialty care provider(s), and psychiatrist (if applicable);
b. Obtain the member’s authorization, as required by law, to receive and share appropriate health care information;
c. Provide information about the MCO’s procedures for accessing long-term care services in the benefit package;
d. Provide the member with education on how to obtain needed primary and acute health care services;
e. Educate members in the MCO’s expectations in the effective use of primary care, specialty care and emergency services; including:
i. Any procedures the provider must follow to contact the MCO before the provision of urgent or routine care;
ii. Procedures for creating and coordinating follow-up treatment plans;
iii. Policies for sharing of information and records between the MCO and emergency service providers;
iv. Processes for arranging for appropriate hospital admissions;
v. Processes regarding other continuity of care issues; and
vi. Agreements, if any, between the MCO and the provider regarding indemnification, hold harmless, or any other deviation from malpractice or other legal liability which would attach to the MCO or emergency services provider in the absence of such an agreement.

Access to Services.ĚýSubject to this Agreement, Pantheon shall make the Software Tools available twenty-four hours a day, seven days a week, provided that Pantheon shall not be responsible for any failure in the Software Tools caused by (a) your systems, configuration, third party products, or services procured by you and any unauthorized access thereof (b) network, telecommunications or other service or equipment, (c) your gross negligence or willful misconduct or the gross negligence or willful misconduct of third parties engaged by you, (d) any Force Majeure Event, and (e) reasonable measures necessary to provide Subscriber with a high performing WebOps platform to meet our obligations under this agreement and provide upgrades to our subscribers for the Software Tools and Services. Pantheon shall minimize such disruption where it is within Pantheon’s reasonable control but may otherwise modify or suspend the Services at any time. Updates to the Services shall be as set out in the Documentation and corresponding release notes. Certain Pantheon features or Services may be deprecated or limited for access or use in subsequent releases. Pantheon retains the right to limit use and storage to those levels purchased by Subscriber at any time. Subscriber shall develop, operate, configure and maintain their Subscriber Content and shall ensure that any service calls are compatible with the then-current APIs for the applicable Services.
